Shoalwater Settlement Agent

Conveyancing and settlement for property owners

Shoalwater sits within Perth’s southern suburbs, roughly 40 km south of the Perth CBD. An accepted offer in Shoalwater is the start of the settlement process, not the end of it, and the weeks that follow are where the detail matters.

We are in Myaree, roughly 30 km to the north. Call us to arrange a home appointment, or we can run the settlement by phone and email start to finish.

Buying or selling a house is a lengthy and complex process and obtaining professional advice will help ensure your smooth and successful property settlement in Shoalwater. The main job of a settlement agent is to transfer the ownership of the property and depending on whether you are buying or selling has various different components.

Shoalwater: the local factors we check early

In Shoalwater the settlement calendar is often driven by the developer and the builder rather than by the parties, which is worth understanding before you sign.

It also changes what we check. A new lot means confirming the plan has been registered and the title has issued in the correct name, that the developer’s requirements have been satisfied and that any design covenants noted against the land are understood by the buyer before settlement.

The rest is the standard sequence: searches, council and Water Corporation enquiries, duty through State Revenue Online, settlement figures and settlement itself, all prepared so that when the title does issue, nothing is holding things up.

The work that comes across our desk most often here:

  • beachside apartments and villas where strata by-laws cover short-stay letting
  • vacant land purchases where the title has not yet issued
  • house-and-land contracts and the timing between land settlement and build start
  • new-lot titles created from a deposited or survey-strata plan
  • first home buyer duty concessions and grant timing, confirmed with RevenueWA

The same applies in the surrounding suburbs: Safety Bay, Rockingham, Peron, Waikiki and Cooloongup.

Where settlements come unstuck, and how we prevent it

Between the accepted offer and settlement day sits several weeks of unglamorous, deadline-driven work. That means searching the title and any restrictions on it, arranging for anything that should not remain on the title to be removed, obtaining rates, water and strata figures, preparing the settlement statement and transfer documents, arranging duty, completing settlement and notifying the authorities of the change of ownership.

Sellers need to complete a verification of identity check before a transfer can be registered. It is quick, but it has to be done by someone authorised, and leaving it to the last week creates unnecessary pressure.

Because settlements are completed electronically in WA, where you live in relation to our office makes no difference to how your settlement is handled.

What we can help you with

We are licensed for every part of conveyancing in WA. The services clients ask for most:

  • Home settlements – Transfers of established houses, duplexes, townhouses and villa strata, for buyers and for sellers.
  • Buying – Everything from the accepted offer through to registration of your name on the title.
  • Transfer duty through State Revenue Online – We arrange stamping, so duty does not need to be paid before settlement.
  • Strata settlements – Apartments, villas and survey-strata lots, including strata information and levy adjustments.
  • Selling – Private homes, commercial property and deceased estates, with documents signed at a time that suits you.
  • Title searches – Shelley can search a title and explain what is registered against it before you commit.

Shelley handles these personally rather than passing them down a chain, which is why clients tend to deal with the same voice from start to finish.

Handled remotely, start to finish

We are based in Myaree, roughly 30 km from Shoalwater. For clients here we are happy to come out for a home appointment, including on weekends, or to run the whole settlement remotely, whichever fits your week better.

Working remotely does not change the service. Documents are sent and explained by phone, signing is done electronically, and settlement in Western Australia is completed online, so nobody attends in person. Give Shelley a call on 0428 336 878 to discuss it.

We offer cost-effective and stress-free settlement

We are licensed in all aspects of conveyancing in Western Australia. Other services that we offer:

Questions we are asked most

I am buying land in Shoalwater and the title has not issued yet. What happens?

Settlement is triggered by the title issuing rather than by a fixed date, so the timing is driven by when the plan is registered. We monitor it, keep your lender in the loop and give you as much notice as we can once a date firms up.

When do I need to appoint a settlement agent?

As soon as your offer is accepted, and ideally before. The earlier we have the contract, the sooner we can order searches and raise enquiries, which is where the time goes.

Do I pay transfer duty before settlement?

Not with us. We arrange stamping through State Revenue Online, so duty is dealt with as part of the settlement rather than needing to be paid beforehand.

Don’t have time to get to an office?

Our services include Shoalwater home appointments, including weekends to sign confusing documentation and to conduct a verification of identity check for sellers to avoid going to Australia post. However, we are also able to work remotely to do all this over the phone or in person.
