Settlement Agent Upper Swan

Upper Swan settlements without the jargon

From our Myaree office, Upper Swan is roughly 35 km north-east. It is in the Swan Valley, an area we look after regularly, and the job is the same wherever the property is: get the paperwork right and the settlement done on the agreed date.

WA does things slightly differently to the eastern states. Conveyancing here is done by licensed settlement agents or by lawyers, and settlement agents work under the Settlement Agents Act 1981 and a code of conduct. We are licensed, and we will tell you when a question is really one for a lawyer.

You do not need to visit us from Upper Swan. The settlement is electronic and the paperwork can be sorted by phone, email and post. Call 0428 336 878 to discuss.

Upper Swan titles, strata and everything in between

Around Upper Swan you get everything from new estates to lifestyle blocks and smallholdings. A brand-new house-and-land deal and a five-acre property with sheds are both conveyancing jobs, just very different ones.

  • New estates sit next to older rural properties, so no two sales look alike
  • Rates and water are adjusted so each side pays only their share
  • Lifestyle blocks and smallholdings often come with special conditions about equipment or structures
  • Bank details confirmed by phone, never changed on the strength of an email
  • Seller identity checks sorted well before settlement

The Upper Swan settlement timeline

When you buy in Upper Swan, your deposit is normally held in a trust account until settlement rather than going straight to the seller. Settlement agents in WA must keep client money in a statutory trust account, and those accounts have to be audited.

At settlement the deposit and the balance of the price go to the seller, less anything owed to their bank, and we confirm the numbers with you before the day.

Settlement agent FAQs for Upper Swan

When is transfer duty paid?

Transfer duty is generally due within two months of the liability arising, and it is usually the buyer who pays. We arrange it through State Revenue Online as part of your Upper Swan settlement.

The owner has died and the property was held as joint tenants. What happens?

The surviving joint tenant applies to Landgate to be registered as the owner, which is called a survivorship application. It needs a death certificate, a statutory declaration and identity verification. We can prepare and lodge it.

I am buying vacant land off the plan in Upper Swan. When does it settle?

Off-the-plan land can only settle after its certificate of title is issued. Check the sunset clause in your contract, and make sure your deposit is held in a trust account.

Can a Myaree settlement agent handle a Upper Swan property?

Yes. WA settlements are completed electronically, so the distance from our office matters very little. Most of the work can be done by phone and email. Ring 0428 336 878 to talk it through.
